Village Pursues Case Against Developer: Plus Many Big Home Sales

Last year, Fox Meadow residents were shocked to see a brazen developer raze an historic Tudor home while his application to demolish it was still be considered by the Scarsdale Committee for Historic Preservation.
Developer Eilon Amidor first demolish half the house at 41 Hampton Road and denuded the remaining portion of all its features and ultimately demolished the other half. The new home is listed at more than double the size of the original at 9,500 square feet with six bedrooms and seven bathrooms. It has been moved forward on the property and the huge structure looms over Hampton Road.
Many wondered whether or not the Village would pursue a case against Amidor in order to collect the fee of $50,000 for demolishing a home without the permission of the Village Committee for Historic Preservation.
We followed up with Village Manager Rob Cole to see what has happened and here is what he shared.
First we asked, “Was Amidor fined $50,000 and did he pay it?”
Cole replied, “The 41 Hampton Road matter is still pending in court, so I can't comment on any fine.”
And we asked, “Was the Village code amended in any way to address the way he diverted it?”
Cole said, “The developer did not exploit a loophole or do an end run around the law; we believe that he violated the Village Code and was therefore issued a summons.”
The code reads, “Notwithstanding any inconsistent provisions of the Code or of any rule or regulation concerning the issuance of building or other permits, no person shall carry out any demolition of a structure which the Building Inspector has referred to the Committee as a potential historic building without first obtaining a certificate from the Committee or Board of Trustees as provided in §§ 182-7 and 182-11 or a written statement from the Committee that the structure does not meet the criteria set forth in § 182-5 and is not an historic building. The certificate required by this section shall be in addition to and not in lieu of any building or other permit that may be required by the Code or any state law or regulation.”
