Oversized Homes on Undersized Lots

Does it seem like new houses are filling more of the building lots than the neighboring homes and extending almost to the lot lines? Perhaps you are not imagining it. Indeed, many of the newly constructed homes are larger than the maximum floor area ratios for their lot sizes as defined by village code. How do these get by the Building Department? One theory is that architects and builders exploit exemptions in the code, which allow them to add additional space in dormers and garages that are not included the floor area ratio (FAR) calculations. Basements, even if they are fully finished, are also exempt if the exterior wall of the basement is less than three feet high. Another method of exceeding the FAR regulations is to apply to the Zoning Board of Appeals to seek a variance, which perhaps some of the developers are doing.
Square footage quoted in the real estate listings varies from the interior square footage shown on the tax role for Scarsdale Village, as they use different methodologies to calculate interior space.

Whatever their methodology – here are a few big new homes on very small lots:
11 Pinecrest Road: The house sits on .24 acres, and according to Village Code, the maximum residential floor area should be 3,500. The listing from the broker shows that the new house will be 6,050 square feet. Since it's not yet built, there is no interior square footage shown on the Village website. The house is currently listed at $2,895,000.
Another new house is at 18 Drake Road which the real estate listing shows as .32 acre and the village website shows as .16 acre. If it is on .32 acre, the FAR regulations say the house should be no larger than 4,350 square feet. This new house is listed at 5,600 square feet and the Village website shows that the square footage is 4,227 square feet. List price is $2,895,000
A new house on .25 acre at 4 Dell Road is listed at $2,665,000 and according to the listing will be 6,000 square feet. The Village website says that the gross residential floor area is 4,193 square feet, still more than the maximum FAR of 3,000 square feet as dictated by Village code.
A new house at 81 Spier Road sold this week for $2,400,000. The house is on 1/3 of an acre and the real estate listing shows it is 5,754 square feet. According to the chart the house should be no larger than 4,350 square feet. The Village lists the interior space of the home at 4,028 square feet.
Perhaps if the Village Trustees want to consider how to reduce the size of new homes, they should take another look at the exemptions to the FAR regulations.

Greenacres Avenue Residents Move To Block Construction Of McMansion On Flag Lot

The owners of a majestic home in Greenacres are moving to prevent the construction of a 6,200 square foot home on a flag lot behind their house. Currently the flag lot holds a 3,400 square foot home and the owners Edith Kallas and Joe Whatley received permission to demolish it. They plan to replace it with a home that is almost twice the size.
According to Scarsdale Village Planner Elizabeth Marrinan, the flag lot was created through a subdivision more than 20 years ago. The property was later re-subdivided again and at that time the Planning Board designated the front property line. When the owners applied to build the new home on the flag lot they used the front property line as designated. Homes in this zone must be set back 30 feet from the front property line and 10 feet from the side property line.
Joel Sachs of Keane and Bean is the lawyer representing Joshua Weismer and Stephanie Weiser, the homeowners of 25 Greenacres Avenue who are seeking to block the construction of the larger home at 21 Greenacres Avenue. He contends that the Planning Board had no jurisdiction to make the decision about the lot line in 1977 when the existing house was built, and that even if they had jurisdiction their decision was wrong. He also argues that none of the neighbors knew about the Planning Board's 1977 decision until June 2014.
Sachs filed an Article 78 petition in August in the State Supreme Court in White Plains challenging the neighbor's permission to build the house. He argues that the front of the proposed house will be 11 feet rather than 30 feet away from his client's home.
Sachs has also asked for an interpretation of the site plan from the building inspector and will take the case to the zoning board.

Another Record-Breaking Sale in Scarsdale

Dawn Knief and Marty Katchis of Julia B. Sotheby's have sold the home of Mary Wallach at 18 Sherbrooke Road for $7.2 million. The 7,834 square foot house was built in 1942 and includes six bedrooms and eight bathrooms. The house features an indoor spa with a 20 x 40 foot heated pool, gym, sauna and Palladian windows. For gardeners, there is a fully automated greenhouse. The house is on 3.02 acres, one acre of which is potentially a separate building lot at 20 Sherbrooke Road.
According to the NY Times, homeowner Mary Wallach was the wife of James G. 
Wallach, the chairman and chief executive of Central National-Gottesman Inc., a pulp, paper and newsprint marketing company. He died at the age of 55 at his home in June 1998 from a cerebral aneurysm.
Wallach became president and chief executive of Central National-Gottesman in 1979 and chairman and chief executive in 1997. The privately owned company was based in Purchase and had sales of more than $2 billion a year. When he passed away in 1998 he was survived by his wife of 27 years, Mary Kerr Wallach; two sons, Andrew and Scott, both of Scarsdale; and his parents, Ira Wallach and Miriam Gottesman Wallach also of Scarsdale.
For tax-watchers, under the revaluation, the home and 2 acres were assessed at $5,113,000 and the potential building lot adjacent to the property was assessed at $2,256,000. Together, they were valued at $7,369,000 and the property sold for $7,200,000.
Taxes on the home on 1.98 acres are $104,111 and taxes on the additional acre are $18,163 bringing the total to $122,274. If it was valued as a single lot with a home at a total value of $7,200,000, the estimated real estate taxes would be approximately $164,000 ($7.2mmm X .02281).

Five More Homes to be Demolished Plus a Big Sale

It was business as usual at the August meeting of the Committee for Historic Preservation where six homes were on the agenda to be cleared for demolition. Five out of the six were approved and a decision on one was deferred to the following meeting. There was a small fracas about a charming cottage on Sage Terrace built in 1922, when the realtor showed up to represent the elderly owners of the house. Since she did not have the necessary paperwork giving her power to represent them, the committee waited while she drove to Greenacres to retrieve them. Though the originally house encompasses the remains of a barn from 1799, interior features do not warrant preservation. Once the owners arrived approval to tear down that house was granted as well.
The Committee was also due to discuss changes to the code that regulates preservation but committee chair Paul Diamond said they were awaiting feedback from the Board of Trustees on the committee's prior comments to the draft.
While the new code awaits review, realtors and developers are having a heyday selling Scarsdale homes, tearing them down, building and selling huge new houses that extend to the last possible inch of buildable space.
