Police came upon an SUV stopped on Mamaroneck Road at 10:35 pm on July 17 and approached the driver. The driver was reluctant to roll down the window and said that he pulled over to call a friend. He said he did not have his license, claiming it was his father's car. At the same time, the Scarsdale police officer received a hotline message from White Plains Police about the search for a white SUV with North Carolina plates in connection with a burglary on Walworth Avenue. The officer told the driver to keep his hands on the wheel while he sent out a dispatch to alert police that he had stopped the suspect. The officer drew his gun and pointed it at the suspect, until back-up arrived. When additional police arrived, the suspect was told to get out of the car. Police found a pellet gun in the drivers side door. The suspect smelled of alcohol but police could not administer sobriety tests at the location. Police noticed that the passenger door was ajar and surmised that someone may have jumped out. They found a cell phone on the passenger seat and two six pack of Smirnoff' Ice and Mike's Hard Limeade.
The suspect identified himself as Erick Osbertos Barrios. He said he was coming from Yonkers to go to Crystal Nightclub but could not tell police why he was in Scarsdale. Police conducted sobriety tests and Barrios was found to have a BAC of .10%. He was charged with criminal possession of a weapon (the stun gun), driving while intoxicated, and driving without a license. Bail was set at $200 and paid by his girlfriend. He was turned over to White Plains police for questioning about the robbery. Due to all the law enforcement items that he possessed, police believe that Barrios poses a safety issue to police.
